This notice explains what personal data we collect through this website, in particular through the entry form for the photo contest PabloBeer – images & sensations, what we use it for and which rights you can exercise. It is provided pursuant to articles 13 and 14 of Regulation (EU) 2016/679 (GDPR).

What data we collect

When you enter the contest through the form on this site we collect:

  • Full name and email address (required: we need them to identify you as the author and to contact you);
  • phone number (optional);
  • where and when the photo was taken and, if you provide it, the name of the venue where you took the photo (we need this to award the prize for the venue from which the most photographs are submitted);
  • the description of the sensation that accompanies your entry;
  • the photograph you submit, together with any technical metadata contained in the file;
  • confirmation of the declaration and acceptance given by ticking the box on the form, with the date and time of submission.

For security reasons and to prevent automated or abusive submissions, the site’s systems also record theIP address and technical information about the browser at the time of submission.

Why we process your data and on what legal basis

  • Managing your participation in the contest – receiving your entry, submitting it to the jury, telling you the outcome and delivering any prizes. Legal basis: performance of the relationship created by your entry and of measures taken at your request (art. 6.1.b GDPR).
  • Publishing and using the entry in the ways and within the limits set out in the contest rules: communication, promotion, publication of the contest, exhibitions, catalogues, websites, social media and related materials, with credit to the author. Legal basis: the non-exclusive licence of use you grant by accepting the rules (art. 6.1.b GDPR).
  • Website security and abuse prevention. Legal basis: the controller’s legitimate interest in protecting the service (art. 6.1.f GDPR).
  • Legal obligations, accounting and tax obligations connected with awarding the prizes. Legal basis: legal obligation (art. 6.1.c GDPR).

Providing the data marked as required is necessary in order to enter: without it we cannot register your entry or contact you.

Photographs and the people in them

Photographs may contain images of identifiable people. By accepting the rules you declare that you are the sole author of the entry and that you have obtained the necessary releases from the people portrayed and for any private locations or property photographed. The controller processes such images within the limits of the licence granted and removes them from its channels upon a substantiated request from the person concerned.

If you recognise yourself in a published photograph and did not authorise it, write to italia@pablobeer.it: we will remove the image without delay.

How long we keep your data

  • Entry data (personal details and contacts): for the duration of the contest and for 12 months after it ends, the period needed to handle the prize-giving and any disputes. After that it is deleted.
  • Photographic entries and descriptions: for the duration of the licence of use granted under the rules, unless you ask for removal.
  • Accounting and tax data relating to prizes awarded: for the periods required by law.
  • Technical and security logs: for a limited period, as a rule no longer than 12 months.

Who we share your data with

Your data is neither disclosed publicly nor sold to third parties for commercial purposes. The following may access it, as data processors and under specific agreements:

  • the hosting provider that hosts the website and the mailbox;
  • the jury members appointed to assess the entries;
  • any technical service providers for website maintenance and prize shipping, limited to what is necessary.

Where processing involves transferring data outside the European Economic Area, the controller does so in accordance with articles 44 and following of the GDPR, relying on adequacy decisions or standard contractual clauses.

Cookies and technical tools

The site uses technical cookies, necessary for it to work: session handling, storing your chosen language and correct form submission. These cookies do not require consent.

Any third-party cookies or tools other than technical ones – including form anti-spam protection – are activated only after your choice through the cookie management panel, where you can change or withdraw your preferences at any time.

The site does not use your data for profiling or for automated decision-making.

Your rights

You may at any time ask the data controller to:

  • access your data and obtain a copy (art. 15);
  • correct inaccurate or incomplete data (art. 16);
  • erase your data, in the cases provided for (art. 17);
  • restrict processing (art. 18);
  • receive your data in a structured format and transfer it to another controller (art. 20);
  • object to processing based on legitimate interest (art. 21).

Write to italia@pablobeer.it: we will reply within one month. If you believe the processing breaches the law, you may lodge a complaint with the Italian Data Protection Authority (garanteprivacy.it) or bring the matter before the courts.

Please note that asking for your entry data to be erased while the contest is running means you can no longer take part and cannot be awarded any prize.

Minors

The contest is open to adults only and the site promotes an alcoholic drink: we do not knowingly collect data from anyone under 18. If we find that a minor has entered, their data will be deleted and the entry cancelled.

Changes to this notice

The controller may update this notice to reflect legal or organisational changes. The version in force is always the one published on this page, with its last-updated date.
